Without prejudice communication
In the case of Eversheds LLP v Gray, the Employment Appeals Tribunal has overturned an Employment Tribunal ruling that certain without prejudice communications between parties’ representatives should be made public.
Costs awards in the Employment Tribunal
The case of Bouheniche v DWP is a reminder that even when an employee wins all or part of his claim, and is awarded compensation, a costs award can still be made against him if he has acted unreasonably in conducting the claim.
TUPE service provision protections
The Tribunal has ruled that employees of a service provider cannot take advantage of legal protections designed to ensure their rights are not affected when the company they work for is taken over by a new owner, in circumstances where the client that services are being provided to also changes at the same time.
Record Tribunal Award
A doctor dismissed from her position at a Yorkshire hospital, following the birth of her baby, has been awarded a record breaking £4.5 million for unfair dismissal, sex and race discrimination.
Compensation Limit Increase
From 1 February 2012, the maximum unfair dismissal compensatory award will increase to £72,300 from the current limit of £68,400.
The 2012 changes also include the following increases:
v the maximum amount of a week's pay used to calculate a statutory redundancy payment, and the basic and additional awards for unfair dismissal, will increase from £400 to £430
v the minimum compensation
where an individual is excluded or expelled from a union, in contravention of s.174 of the Trade Union and Labour Relations (Consolidation) Act 1992, will increase from £7,600 to £8,100
v the limit on a statutory guarantee payment will increase from £22.20 to £23.50 per day.
